The present conditions and provisions apply only between:

 Pikok Sports, Hunting, Camping, Boating and Bicycle Equipment Retail Sale LLC

A limited liability company registered as per the Kuwaiti laws with commercial registration number 5170722, with headquarters on the fifth floor, Abdullah Mubarak Street, Al Enmaa Tower, Qiblah, Kuwait (hereinafter referred to pikok.com).

And any person purchasing (hereinafter referred to “the client”)

Referred to together as the “parties” on https://pikok.com

(referred to as the “website”).

The client acknowledges that it has reached 21 years of age or more. It has legal capacity to conclude a contract through the electronic commerce channels and thus can apply to the website. The parties agree that their relationship shall only be subject to these conditions and provisions.

Even though the website pikok.com aims at guaranteeing that the information on the website is full and accurate, it may include some errors or inaccuracies. The website pikok.com maintains its right to correct such errors or inaccuracies at any time, as well as make changes to or update the information present on the website relating to prices, availability and product description. Therefore, it was agreed that the conditions and provisions applied are valid on the site at the time of filing an application on the website.

Availability of the product

The products and prices that we offer are valid as long as they are visible on the website, unlike the special offers. We insist on the clients to check the availability of the merchandise sold on the information site. If it shall be established that the product ordered is not available, the website pikok.com maintains the right to annul the order provided that it notifies the client. If any of the products is not available, pikok.com shall inform the client that it cannot ship the unavailable product. The remaining order shall be processed and shipped to the client as per the confirmation of the client within a certain time indicated in the email, which provides information for tracking the order.

The order

The products published by pikok.com on the website are formed of the purchase offers relating to the products presented on the website (“offer”). The website pikok.com reserves the right to refuse, correct, annul, or terminate any offer for any reason without notice and/ or limitation of the amount that an be purchased from any item displayed in the offer. The order sent through the website pikok.com is considered as your order (“order”). It might be necessary, at any time, that pikok.com investigates the personal information or information relating to the credit cards or payment cards from the issuer of your credit cards or the payment service providers before accepting any request. Upon investigating the payment for the request, you will receive an email to confirm the transaction.

If you wish to purchase any available product or service through the service (“purchase”), then you might be requested to present specific information relating to your purchase, including without limitation, the credit card number, the expiration date of the card, the billing address and shipping information.

You acknowledge and guarantee that: (1) you have the legal right to use any credit cards or other payment means relating to any purchase operation; (2) the information provided to us is valid, true and complete.

Upon presenting such information, you grant us the right to provide others with the information to facilitate the completion of the purchase operations.

We reserve the right to refuse or annul your order at any time for specific reasons, including without limitation, the availability of the product or service, errors in the description or price of the product or service, error in your order or any other reason.

We reserve the right to refuse or annul your order if there shall be any doubt of fraud or unauthorized or illegal operations.

To make an order, you will be required to follow several steps:

  • The client shall create an account or enter as a guest user on the website, specify his/ her identity to launch the system
  • The client shall place the products in the cart
  • The client shall choose the delivery means
  • The client shall choose the payment means
  • The client shall pay
  • The client shall receive an email from pikok.com registering the payment

The email is sent as confirmation of the validity of approval from pikok.com of the client’s order and thus constitutes a sale contract between the parties.

Prices and payment means

You agree to the payment of all prices, taxes, and fees indicated in the transaction. All amounts are in Kuwaiti dinars. pikok.com includes a large number of products and it is always possible that some products indicated on the website are priced incorrectly, even though we try our best. We shall check the prices as part of the shipping procedures so that when the correct price of the product is less than the indicated price, we deduct as per the lower price. If the correct price of the product is higher than the price indicated on the website, then we will charge the correct price.

It is understood that the products on the website exclude taxes, shipment fees, prices of specific packages, or prices of other optional services chosen by the client and that are collected separately. The client shall be informed of these fees on the page summarizing the order before the final processing of the order. Usually, we impose fees on purchases from your credit card before sending your order. In case the product stock is out, we shall return the funds to the credit card or your payment card.

The client may pay for the purchases by credit card or visa payment card, MasterCard, PayPal, American Express or in case upon delivery. Cash upon delivery shall not apply to large elements. pikok.com guarantees the safety of payment by bank cards using the SSL (Secure Socket Layer) system by processing payments using Checkout.com.


  1. Delivery/ Shipment

Where to deliver? Where to ship?

All out orders can be delivered to all areas in the State of Kuwait that are indicated on the website.

The delivery times indicated on the website are calculated from the date of confirmation of the payment if it is completed by card and by email if payment is made in cash upon delivery.

Delays in delivery may occur due to local holidays, sales periods, force majeure or closing and weekends, or any other incidents outside the control of pikok.com.

  1. Guarantee of our products

In case of any fundamental faults, the same shall be investigated by pikok.com. The preliminary cost of the element shall be reimbursed along with the transportation fees paid during the order. The guarantee covers the faults in the products during regular wear and tear or before use.

This guarantee does not apply to any problems resulting from neglect, deterioration, or ill-use of the product by the client. For all kinds of faults, kindly contact customer service or the link “contact us” on the website or email hi@pikok.com.

  1. Order cancellation

If you wish to cancel your order, you can either contact hi@pikok.com or send a request through the link “contact us”. Upon filing a request, we will exert all efforts to meet your needs as long as the order is still being processed and was not delivered to the shipping company.

The orders can be cancelled from the system as long as they were not shipped yet (they were not delivered to the shipment company). Cancellation is completed though the system directly rather than through the website or application; therefore, the client should contact the customer care department that will execute the request of the client through the system.

  1. Product returns

It is important to us that the online purchase experience through the website is as pleasant as possible. If you are not completely satisfied with your purchases on the website and you wish to return the product, you can contact the customer service team or request returning the product home from our site and the rapid mail will collect it from your location. Any return or replacement, whether at the store or at home, should include the printed request receipt.

After our team confirms the return and that it meets the requirements of returns indicated below, we would be happy to return the amount, minus the transportation fees, to the card used for making the purchase if payment was completed by card, and by coupon if payment was made in cash.

The products should be in their original packaging. All technical products should undergo quality control at the time of return.

The product shall be returned for a refund within 14 days (except for underwear, swimwear, cosmetics and perfumes, hair products or customized products as per the request of the client). The product should be new and unused. It should be valid for resale and should be returned with the stickers of the product. All the components of the returned product should be returned with the product. pikok.com maintains its right to refuse the return that does not meet the return requirements indicated these conditions and provisions.

  1. Force Majeure

pikok.com shall not be responsible for the failure or delay in the performance of any of its commitments towards you, whether fully or partially, or for any damages or losses that you might bear, if such failure of execution, delay, damage or loss was due to a force majeure or natural disaster.

  1. Exceptions and liability limitations

To the extent allowed by enforced laws, all the products purchased through the website shall only be subject to the enforced guarantees, if any, presented by the manufacturers, distributers and suppliers of the products. To the extent allowed by the enforced law, pikok.com does not present any declarations, guarantees, commitments, or conditions of any nature, whatsoever, whether implicit or explicit. It shall not present and may not present any other guarantee otherwise. Without limitation to the previous provisions, pikok.com explicitly waivers/ does not hold any responsibility relating to requests concerned with normal wear and tear, ill-use or inadequate use of the product, amendment of the product, or invalid choice of the product. The responsibility of pikok.com, as per the measures indicated in the present conditions and provisions, relating to online sale, limited to the purchase prices paid to pikok.com for the concerned order.

  1. The entire contract

If any condition or clause of the present conditions and provisions shall be considered null as per the law, deeds, or decision issued by the court or administrative authority, the other provisions shall remain effective.

pikok.com shall exert all efforts to replace these provisions with a valid clause whose effect shall be close to the essence of the present conditions and provisions. If none of the parties shall request the execution of any provision of the present conditions and provisions, whether permanently or temporarily, then the said patience shall not be considered as waiver of the clause in any means.

  1. Competence and enforced laws

The judicial competence and enforced laws for the present conditions and provisions are the laws enforced in the State of Kuwait.

Pikok guarantee policy

Every Pikok product is guaranteed as indicated below:

Guarantee against faults:

Based on the product, Pikok presents limited guarantee against material and manufacturing faults starting from the date of purchase. To determine the length of the applied guarantee term (“guarantee term”), kindly refer to the product page on the website.

Kindly make sure that you keep your receipt as this document shall be necessary to practice your guarantee rights.

Guarantee coverage:

This guarantee only applies to the products manufactured by Pikok or for it, that can be determined by the trademark Pikok or the sticker with its logo. Pikok guarantees every Pikok product against material or manufacturing faults (“faults”) for the guarantee term indicated on the product sticker (“term”), commencing from the date of receipt of the product by the buyer (“guarantee”).

If the product shall be replaced during the guarantee term, then the replacement product shall be guaranteed for the remaining term of the guarantee of the original product.

Exceptions:

The guarantee is not valid for any products other than Pikok products, even if packaged or sold with a Pikok product. The same applies to any imitation product.

 Other exceptions include:

  • Faults resulting from regular wear and tear (the guarantee duly applies to regular use but exempts irregular use).
  • Faults resulting from accidents, neglect, ill-use, misuse, wrong application or products not relating to Pikok
  • Faults resulting from being subject to harsh natural conditions, liquids or gases
  • Faults resulting from dealing with third parties (such as mail services, airlines, hotels and the like)
  • Faults resulting from services (including repairs) that are completed by any party other than the approved Decathlon representative
  • Faults resulting from amending the product without permission from Pikok
  • If the serial number of the product is removed or distorted or if the displayed serial number does not coincide with the nature, kind or origin of the product

Treatments:

Limits of the guarantee

This guarantee and compensation indicated therefor in the present document are exclusive. It replaces all other guarantees, compensations and conditions, whether written or oral, implicit or explicit. Pikok shall not bear responsibility specifically for any and all other guarantees, whether implicit or explicit, including, without limitation, guarantees for marketing, being valid for a specific object, property right or non-violation.

Pikok does not guarantee that it shall be able to repair any product as per this guarantee or present any alternative product that meets all the characteristics and functions of the original product.

The guarantee grants you specific legal rights and you may have other legal rights. This amendment applies only in case the sale scope is within the State of Kuwait.

Specification of damages

Pikok is not responsible for any direct, indirect, special, accidental or causal damages (such as the loss of content, loss of use, loss of time and the like), or any moral damages, including without limitation, damages resulting from persons and suffering, emotional damages, loss of will, loss of profit, loss of business, loss of expected savings, loss of use, loss of good will, whether the same was due to the damage (including neglect or violation) as a result of a fault in the product.

If the Kuwaiti law does not allow the benefit of such exceptions, or limitation of damages, accidental or causal exceptions, the aforesaid exceptions do not apply to you.

How to obtain the guarantee service?

If you shall establish the presence of any fault in your Pikok product during the valid guarantee term, then you should contact the customer service department as indicated in the “contact us” section below to replace your product. When contacting customer service, you will be asked to provide the following:

  • Your name
  • Address and phone number
  • Receipt
  • Purchase date

 

 The customer service representative will provide you with related directions on how to ship your product to our service center. After the receipt of the product, the service center will check the product and issue a report indicated whether the product requires repair or replacement and whether the faults are covered by insurance.

Important:

Kindly present a copy of your original receipt to the service center to be covered by insurance.

Important:

Before delivering your product to the guarantee service, you are responsible for removing your products and making sure that you did not leave anything or any element of the product as required. Pikok is not responsible for any elements remaining with the products sent to us for repair or replacement.

  

Products included in the guarantee

 

Replacement of the product

 

If the product needs replacement, the service center shall maintain the product and arrange with us directly to provide you with a new product; however, it will not provide you with an alternative directly. If the product shall no longer be available, Pikok will replace the product for the same price as chosen for the product. In this case, one of our customer service representatives will contact you for completing the receipt of this new product.

If the product is not subject to repair and cannot be replaced with a similar product, you will be provided with a credit or return notification. 

Delivery

In case of repair or replacement, Pikok will cover any costs for returning the product to you. However, you will be responsible for the shipment charges of the product to the service center, including the costs for packaging, shipment and applicable taxes.

Property rights

When replacing the product or any part thereof, any replacement element shall become your property and the replaced element will become the property of Pikok. When the funds are returned, the returned product shall become the property of Pikok.

Sale Conditions

 The guarantee policy was merged with reference to the sale conditions.

If you have any remarks, comments, questions, requests and/ or other concerns relating to the guarantees, kindly contact customer service on hi@pikok.com.

The guarantee is valid for products that were used within specific standards. The guarantee does not include for example without limitation:

 

  1. Products that have exceeded the guarantee term
  2. Damages resulting from the ill-use of the product
  3. Accidental damage to the product
  4. Products that do not include a serial number/ structure (bikes and sports equipment)
  5. Fault in the digital product due to user settings
  6. Negligence and inappropriate care in the maintenance of the product
  7. Products that are considered subject to natural depreciation or wear and tear (tires, wheels, etc.)
  8. Failure to install, operate, or use products as per the directions of the user, specification, or conditions available to the client by Pikok or any amendment or repair by you or by a third party of any of the repairing parties adopted by Pikok
  9. Damages resulting from fire, lightning, storms, sabotage, or unsafe transportation.

 

Remark: according to the nature of the fault, Pikok shall repair the faulty product or replace it, as per its discretion. If the faulty product was not replaced or repaired regardless the reasonable efforts made by Pikok, then Pikok shall grant its client a balance equivalent to the original price paid by the client in return for the faulty product. This will be the sole solution that the client will have a right to.

 

If the product was returned to Pikok without valid reason or a fault resulting from any of the conditions indicated above, Pikok shall maintain its right to refuse the request of the client and return the product to the client on the latter’s expense. (we believe that the client has the right to retrieve what it paid as long as the same was completed within 14 days if the client shall consider that the product is not suitable, even if it was not damaged).

 

Guarantee on bicycles

 

  1. Two-year guarantee on bicycles and two-year guarantee on the front structure
  2. 6-month guarantee on parts subject to erosion – internal and external pipes, break locks, break steering, pedals, chain, front and back rails, break lines, lights, tires, gears and gear change chains
  3. Other conditions that are not covered by the guarantee:
  4. Damage resulting from third parties or intentional damage or neglect
  5. Invalid use and maintenance
  6. Amendments to the bicycle
  7. Use of non-original parts
  8. Natural disasters
  9. Damage during transportation

 

Returns

 

Free returns

Returns by the website pikok.com are free and simple.

If you wish to return the product, you have to register your return with us within 14 days from the date of receipt. After that, all you have to do is wait and we will organize the return.

As part of our policy, all returns from the State of Kuwait will be free.

The returns that do not meet our conditions may not be accepted. Therefore, kindly make sure that all products are returned in their original unused condition and in their original packaging. Kindly note that taxes and payment fees that are paid upon receipt and delivery are not reimbursed upon return.

For reasons relating to cleanliness, underwear, swimwear, cosmetics and perfumes are not subject to return

Kindy return the product bags, certificates of origin and boxes as they are considered part of the product.

We guarantee that all the products delivered from pikok.com warehouse are in excellent condition. If you receive a faulty product, kindly contact the customer service team immediately.

 

Returning products

If you are not fully satisfied with your purchases through the website and you wish to return the product, you can contact our customer service term or request the return of the product home from our online website. Our representative will collect it from your location. Any return or replacement operation should include a printed receipt of the order collected from the house.

After our team checks the return and confirms that it meets the below said return requirements, we will be happy to return the amount, minus transportation fees, to the card used during the purchase, if payment was made by card, and by coupon if the purchase was made in cash. The products should be in their original packaging. All technical products will be subject to quality control upon return.

The product may be returned for a refund within 14 days. The product should be new and subject to resale. The stickers should be enclosed with the product. All the components of the returned product should be returned with it. The website maintains its right to refuse any return that does not meet the return requirements indicated in the conditions and provisions.

 

Intellectual property

The service, its original contents, characteristics, and functions are considered the exclusive property of pikok.com and license owners. The application is protected by publishing rights, trademark, and other Kuwaiti and foreign laws. Neither our trademark, nor any emblem or commercial characteristic may be used with any other product or service without the written prior permission from pikok.com.

 

Compensation and disclaimer

You agree to exempt and compensate pikok.com, the officials, members of the Board, employees and agents thereof for any losses, damages, or expenses, including attorney fees of a reasonable amount, rights, requests, measures of any kind an injury (including death) resulting from or relating to your use of the product purchased or used. You acknowledge that pikok.com is not responsible I any way after your receipt of the product, whether the same was a result of an accident, injury, illegal use or action or measure. You discharge them from the time of arrival and delivery of the product sold to you.

pikok.com also requests from its clients the safe use and caution and commitment to the laws enforced in the State of Kuwait for the use of the product purchased. It is not responsible for any matter resulting from the error of its clients or others.

 

Hacking

pikok.com is keen on protecting the site or application from any illegal hacking. There is no means of maintaining its security 100% and thus it shall not be responsible for any illegal hack and theft or acquisition of information, financial data or personal information of the clients.
